General terms and conditions of sale of Everyprint S.L.

These General Terms and Conditions of Sale (“GTCS”) apply, without restriction or reservation, to all sales concluded by the Vendor with non-professional purchasers (“Customers or the Customer”) wishing to acquire the products offered for sale (“Products”) by the Vendor on the Wellpapers.com website.

Article 1. Object

The purpose of these terms of sale is to define the contractual relationship between Everyprint and the buyer and the conditions applicable to all purchases made through the Wellpapers.com website. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the purchaser declares, on the one hand, that the purchase of products on the Wellpapers.com site is not directly related to his or her professional activity and is limited to strictly personal use and, on the other hand, that he or she has full legal capacity, enabling him or her to commit to these general conditions of sale.

Everyprint S.L. reserves the right to modify these terms and conditions at any time, in order to comply with new regulations or to improve the use of its website. As a result, the applicable conditions will be those in force at the date of the buyer’s order.

Article 2. Products

The products presented on the site are in the category of: wallpapers.

Each product is presented with its technical specifications and under a unique reference number. Photos are subject to change at the Company’s discretion. The colors in the photos are not contractual and may not correspond to the samples sent; Everyprint cannot be held responsible for these differences due to the quality of the screens.

Article 3. Rates

The prices appearing on the product sheets of the internet catalog are in Euros (€), all taxes included (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Wellpapers reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order shall be the only price applicable to the purchaser. Free delivery on all products.

Article 4. Ordering and payment

Before placing an order, the buyer must create an account on the Wellpapers.com website. The account creation section can be accessed directly from the side menu bar. Each time you visit the site, if you wish to place an order or consult your account (order status, profile, etc.), you must identify yourself using this information. The site allows the buyer to order and pay for products in several stages, with 2 payment options to choose from:

Secure payment by Paypal or credit card: the buyer selects the products he wishes to order in the “basket”, modifies them if necessary (quantities, references…), checks the delivery address or enters a new one. Then the shipping costs are calculated and submitted to the buyer, along with the name of the shipping company. The buyer then selects the payment method of his choice: “Payment by Paypal”. The next step is to check all the information, read and accept the present terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the PAYPAL secure interface, where he or she can enter his or her Paypal account details or personal credit card number. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by Paypal account or credit card is irrevocable. In the event of fraudulent use of the card, the purchaser may demand cancellation of the card payment, in which case the sums paid will be credited or refunded. The cardholder is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction. The amounts deducted are reimbursed by the bank within a maximum of one month of receipt of the cardholder’s written objection. No costs will be charged to the holder for the return of the sums.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge of them and waiver of the right to invoke one’s own terms and conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the purchaser has an e-mail address and has provided it on the order form, the Wellpapers company will send the purchaser confirmation of the registration of the order by e-mail.

Article 5. Reservation of ownership

Everyprint retains full and complete ownership of the products sold until full payment has been received, in principal, costs and taxes included.

Article 6. Withdrawal

All products supplied by the seller are covered by the legal warranty provided by articles 1641 et seq. of the French Civil Code.

Wrong part numbers or incomplete product:

In the event of delivery of products not conforming to the order form, the customer will be sent the balance of the order at Everyprint’s expense.

In the event of delivery of references different from those ordered, the products will be returned at the expense of Everyprint, which will produce a replacement for the desired references.

Transport damage :

Essential condition for a refund or replacement of goods: If, at the time of delivery, the original packaging is damaged, torn or open, the buyer must check the condition of the items.

If they have been damaged, the buyer must refuse the package and note a reservation on the delivery slip (package refused because opened or damaged).

The buyer must notify the carrier of any reservations to be made within the allotted time, and send a copy to Everyprint, which reserves the right to refuse the return, refund or replacement of products. In the event of non-conformity of a product sold, it may be returned to the seller, who will take it back, exchange it or refund it. Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are placed by La Poste via COLISSIMO, a delivery service with tracking and delivery without signature. Delivery times are given as an indication only; if they exceed thirty days from the order date, the sales contract may be cancelled and the purchaser reimbursed. Everyprint may provide the purchaser with a tracking number by e-mail. The buyer is delivered to his home by his letter carrier. If the purchaser is absent, he will receive a notice of passage from his letter carrier, allowing him to collect the products ordered from the nearest post office, during a period indicated by the postal services. The risks associated with transport are borne by the purchaser from the moment the items leave the premises. The buyer is obliged to check the condition of the packaging and the contents of the goods on delivery, in the presence of the employee of La Poste or the delivery person. In the event of damage in transit, any protest must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by Wellpapers benefit from the legal guarantee provided by articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or reimbursed. Article 9. Liability

Everyprint accepts no responsibility for the misuse or misapplication of products ordered by the customer. Everyprint is in no way responsible for consequences resulting from: storage of products in abnormal conditions or conditions incompatible with their nature, their transformation, non-compliance with installation instructions, abnormal wear resulting from poor maintenance, choice of glue unsuitable for installation, or imperfect installation, non-compliance with installation instructions for non-woven paper, deterioration of products due to water infiltration, impact or inappropriate use, temperature or humidity levels. Although we strive to present the colors of our products as faithfully as possible, we cannot guarantee that your computer screen will accurately reflect the color of the products you receive.

Article 10. Intellectual property

All elements of the wellpapers.com website are and remain the exclusive intellectual property of Everyprint. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.

Article 11. Personal data

Everyprint undertakes to maintain the confidentiality of any information provided by the purchaser which may be required for the use of certain services. All information concerning him/her is subject to the provisions of law no. 78-17 of January 6, 1978. To this end, users have the right to access, modify and delete information concerning them. Article 12. Dispute resolution

Any dispute relating to the use of the www.Wellpapers.com website is subject to Spanish law. Exclusive jurisdiction is granted to the competent courts of Barcelona.

We reserve the right to change these conditions of sale from time to time and ask you to refer to them whenever you place an order.
